The practical and personal dynamics around disputes, whether arbitration or litigation, are quite different from those around positive legal developments, such as setting up a trust or investment programme, and they need to be handled (and legal teams selected) accordingly. When things go wrong, parties will scour documents with a fine-tooth comb and examine the small print with a large magnifying glass, looking for errors that may be advantageous to them, with a focus and attention that is altogether different from when an arrangement is first put together. 

When disputes cross borders and involve issues and/or parties in both North America and Latin America (LatAm), selecting the right legal team to handle the multiplicity of issues and nuance is even more critical.
